2. Subject of the Agreement
These Terms and Conditions regulate the offer, transmission, and acceptance of purchase orders for artworks on www.giada-todesco.com between users and MY CHERRY DI GIADA TODESCO.
3. Characteristics and Pricing of Artworks
Each artwork is described with its physical characteristics (technique, dimensions, materials). Artwork imagery on the website is illustrative; actual colors may vary slightly depending on display settings.
All prices displayed on the website are in Euros (€) and inclusive of VAT and any applicable taxes. Shipping costs, unless stated otherwise, are borne by the purchaser and calculated prior to order completion.
4. Secure Payment Methods
Payment for artworks purchased on the site is conducted through certified and authorized external payment gateways (e.g., Stripe, PayPal, credit cards). All financial transactions occur over secure, SSL/TLS encrypted connections. Financial data is never handled, routed, or stored on MY CHERRY DI GIADA TODESCO servers, being managed solely by licensed financial providers in full compliance with PCI-DSS standards and PSD2 regulations.
5. Exclusion of the Right of Withdrawal & Artwork Personalization
Pursuant to Art. 59, paragraph 1, letter c) of Italian Legislative Decree no. 206/2005 (Consumer Code) and applicable EU consumer protection directives, the right of withdrawal is expressly excluded for the supply of goods made to the consumer’s specifications or clearly personalized.
Following the completion of the purchase by the client and prior to shipment, the Artist undertakes the final and essential stage of the artwork's creation: its direct customization, which takes place through dedicated artistic details or an indelible, permanent, and irreversible handwritten dedication crafted directly onto the artwork's material support, dedicated specifically to the final collector and buyer of the artwork's emotion.
Consequently, the acquired artwork qualifies in all respects as a unique, custom-tailored, and personalized creation; therefore, the right of withdrawal is strictly not applicable, and the artwork cannot be returned or refunded once the purchase is concluded.
6. Shipping and Insured Delivery
Artwork deliveries are carried out securely via DHL express courier with full insurance coverage, ensuring complete integrity and protection during transit. Estimated delivery timeframes are indicated during checkout.
Alternatively, exclusively for deliveries within the Milan area and subject to availability, direct hand delivery can be arranged by contacting customer support post-purchase.
7. Intellectual Property
All copyright and intellectual property rights concerning the artworks, imagery, texts, and design on this website belong exclusively to Giada Todesco and MY CHERRY. Any unauthorized reproduction or distribution without prior written consent is strictly prohibited.
